Atelier Birdsong LLC, DBA Birdsong Apothecary (“Birdsong Apothecary”) owns and/or operates the internet site located at www.BirdsongApothecary.com (the “Site”). These Terms of Use (“Terms”) apply to your access to, and use of, the Site and features and applications accessible through, or in connection with, the Site, including without limitation your purchase of products or scheduling or purchase of services (collectively, the "Services").

By accessing or using the Site or the Services, you agree to be bound by the terms and conditions described here, Birdsong Apothecary’s Privacy Policy, and any additional terms incorporated by reference. If you do not agree to all of these terms, please do not use the Site or the Services.

Birdsong Apothecary reserves the right to change or modify any of the terms and conditions contained in the Terms at any time and in its discretion. The practices described as “energy work,” “Intuition Medicine®,” “Energy Medicine,” “energy anatomy systems,” “herbalism,” “intuitive guidance” or related modalities are not recognized medical treatments and are not a substitute for licensed medical care. All products offered for sale, including body butter, herbal preparations including “Aura Clearing Mist,” and related goods, are intended for personal joy, wellness inspiration, or aesthetic use, only. These products are not drugs or medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Statements regarding products and services have not been evaluated by the U.S. Food and Drug Administration.

Limitation of Liability

The Site contains information about “energy medicine,” including “intuitive assessments,” “energy healing,” and “spiritual wellness” (collectively, “Energy Medicine”). Although Energy Medicine may have emotional, spiritual, and physical health benefits, it has yet to be fully researched by the Western academic, medical, and psychological communities; therefore Energy Medicine is considered “experimental” and “alternative.” The State of California does not license any Energy Medicine practitioners, and considers Energy Medicine to be alternative or complementary to the medical practices that are licensed by the State of California.

You understand that when using Energy Medicine, the practitioner is not “diagnosing” or “treating” the physical body which is the domain of the medical field and other allied health care professionals, but instead is connecting spirit-to-spirit with a client to assist the client in sensing imbalances within the client’s energy system, as well as exploring the energetic influence of thoughts, beliefs, and emotions and how they may impact the client.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the  quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that Services will be error-free. Before using any topical product, apply a small amount to a small area of skin and wait 24 hours to check for any reaction. Do not use the product if irritation, redness, or discomfort occurs. You are responsible for reviewing product ingredients and avoiding purchase and use if you have known sensitivities or allergies.

VI. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or other contact information provided in connection with the order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

This Privacy Policy describes how Birdsong Apothecary stores, shares, and protects information when you interact with our website, products, or services (collectively, the "Services"), whether you make a purchase, sign up for our newsletter, or otherwise interact with us online. We take your privacy extremely seriously, and we never sell lists or email addresses.

By visiting our site or purchasing something from us, you engage in our Services and agree to be bound by our Terms of Use, including this Privacy Policy.

We do not direct our Services to customers outside the United States. If a customer uses the Services from outside the United States, please note that we transfer the data, including Personal Data, to the United States and process it here. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit, and ensure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

XII. Children's Privacy

The Services are not directed to children under 18, and Birdsong Apothecary does not knowingly collect Personal Information from children under 18. If we become aware that we have collected Personal Data from children, we will promptly delete it.

Birdsong Apothecary Shipping Policy

 

Effective Date: April 14, 2026

Thank you for visiting and shopping at Birdsong Apothecary. All of our orders are shipped via USPS or UPS. You will receive an email update with your tracking number once your order has shipped.

I. Delivery Times

The Apothecary is a small (one-woman) operation working hard to ensure that your orders are thoughtfully and safely packaged and shipped in a timely fashion. Please allow up to 3 business days for order processing and shipping. Orders are not shipped or delivered on weekends or holidays. If we are experiencing a high volume of orders, shipments may be delayed by just a few days. Additionally, nationwide shipping delays (such as those caused by holiday volumes or inclement weather conditions) may have an impact on your estimated delivery date. If you have concerns or need delivery by a specific date, please write to us and we’ll do our best to accommodate your request.

II. Tracking Your Order

After you place your order, you will receive an email confirmation to the email address you provided upon checkout. Once your order is shipped, you will receive a shipping confirmation email with tracking information. Please allow the delivery carrier up to 48 hours to reflect updates on their tracking page. Once your order has been picked up by the delivery company, we only have as much information as we have provided regarding the whereabouts of your order.

Please allow 3-5 business days for your package to be delivered once shipped. We are unable to make date-based delivery guarantees. 

III. Damaged or Missing Deliveries

If your order arrives damaged, please save all packaging materials and damaged goods for claim evidence purposes. Do not attempt to file a claim with the delivery company yourself. Birdsong Apothecary will file a claim on your behalf, and a refund or replacement may be issued pending your cooperation during the claim process.

Notice of damage must be provided within 3 calendar days of delivery confirmation by contacting us and providing the following information:

  • Your order number

  • A description of the issue

  • Clear photographic evidence of the product and packaging

Photos of damaged items and both inner and outer packaging will be required when disclosing damage. Additional photos may be required throughout the claims process and are your responsibility, as the recipient, to provide them. Do not release any products or packaging to any other entity, including the carrier, repair estimate facilitator, etc. before consulting with Birdsong Apothecary. Doing so may risk invalidating the claim in progress and your ability to receive compensation for the lost or damaged item. ‍

Birdsong Apothecary Policies on Returns & Refunds

 

We accept returns for a refund or exchange within 7 days of the delivery date, provided the following requirements are met: 

  • The product is unopened, unused, and factory sealed

  • The item is in its original packaging and in a resalable condition

  • Return authorization is obtained in advance

For hygiene reasons, we cannot accept returns of opened or used products. We reserve the right to determine whether merchandise meets our return eligibility standards. Original shipping charges are not refunded.

I. Non-Returnable Items

The following items are final sale and non-returnable:

  • Sale, clearance, or promotional items

  • Gift cards

  • Limited-edition releases or opened items (unless defective)

  • Services

II. Return Authorization‍ ‍

All returns require prior written authorization. To start your return, please contact us with your order number, your email used for placing the order, and the reason for your return. You will receive a prepaid shipping label for your return if it is approved.

Returned items must be shipped within 7 days of authorization approval.

‍III. Damaged, Defective, or Incorrect Items

If your order arrives damaged, defective, or incorrect, please contact us within 7 days of delivery confirmation, and provide:

  • Your order number and email address used for the order

  • A description of the issue

  • A clear photo of the product and packaging

Upon verification, we will provide a replacement, store credit, or refund to the original payment method.

‍IV. Refunds and Store Credit

Once an approved return is received and inspected:

  • You will be notified of approval or denial.

  • All product refunds are subject to a restocking fee of 15% of the product value. This fee will be deducted from your refund amount.

  • Approved refunds will be issued to the original form of payment within 7–10 business days; store credit will be issued more quickly.‍ ‍If a refund is issued, it may take longer than noted to appear on your account.

  • Original shipping fees are non-refundable unless the return is due to our error or product defect, as outlined above.

‍V. Product Information & Limitation of Liability

Customers are responsible for reviewing ingredient lists and conducting patch tests prior to use. We attempt to be as accurate as possible. However, we do not warrant that product descriptions or results or other content on the site is accurate, complete, reliable, current, or error-free. To the fullest extent permitted by California law, Birdsong Apothecary shall not be liable for indirect, incidental, special, or consequential damages arising from allergic reactions, skin sensitivities, improper product use, or variations in individual results.

In accordance with California Civil Code §1723, this policy constitutes our posted return policy.
